1. Introduction

Piczell Real Estate Media LLC ("PICZELL," "we," "us," or "our") respects your privacy and is committed to protecting the personally identifiable information ("Personal Information") you provide to us. This Privacy Policy explains what information we collect, how we use it, and under what circumstances we may disclose it to third parties across our electronic booking platforms, digital communication channels, automated messaging systems, and on-site media operations.

2. Information We Collect

We collect information that identifies, relates to, or could reasonably be linked with you, your business, or your property listings. This includes:

  • Contact Information: Name, real estate brokerage affiliation, email address, mobile phone number, and billing/mailing address.

  • Property & Asset Information: Specific property addresses scheduled for media shoots, gate or lockbox codes, property access instructions, square footage details, and metadata associated with uploaded media.

  • Financial & Payment Data: Credit card details, bank account numbers, or billing profiles. Note: All payment processing is securely handled by PCI-compliant third-party gateways; PICZELL does not store raw credit card numbers on our local servers.

  • Technical Data: Internet Protocol (IP) addresses, browser types, cookie data, and tracking details regarding how you navigate our online scheduling and media delivery portals.

3. How We Use Your Information

PICZELL uses the collected data for specific operational, financial, and marketing purposes, including:

  • Service Delivery: Scheduling media sessions, processing invoices, delivering final media assets via secure electronic links, and communicating time-sensitive shoot details.

  • Subcontractor Coordination: Sharing property addresses and specific preparation or staging instructions with our third-party listing preparation subcontractors.

  • Electronic & Mobile Communication: Delivering itemized invoices, automated reminders, and download alerts via electronic means, email, and automated automated text (SMS) messages.

  • Marketing Communications: Sending company updates, promotional discounts, and seasonal offers via email or SMS text message.

  • Legal Compliance: Enforcing our Terms of Use, collecting applicable Texas state and local sales taxes, and responding to lawful legal requests, audits, or subpoenas.

4. SMS & Mobile Messaging Disclosures

  • Consent & Opt-In: By providing your mobile telephone number to PICZELL, you expressly consent to receive automated text (SMS) messages from us related to your orders, scheduling updates, delivery links, and invoices.

  • Opt-Out Mechanisms: You can cancel the SMS service at any time. Just text "STOP" to our shortcode or messaging number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us unless you re-initialize the service.

  • Carrier Protection: Standard message and data rates may apply for any messages sent to you from us and to us from you. PICZELL is not responsible for delayed or undelivered messages caused by mobile carriers.

  • Privacy Isolation: Mobile information, opt-in data, and consent for text messaging will not be shared, sold, or rented to any third parties for their independent marketing use.

5. Sharing & Disclosure of Information

We do not sell, rent, or trade your Personal Information to third parties for marketing purposes. We share your information only under the following strictly defined conditions:

  • With Independent Subcontractors: We share property details, access instructions, and coordinator contact info with our vetted listing preparation professionals (stagers, cleaners) to fulfill the preparation services you order.

  • With Third-Party Service Providers: We utilize secure third-party platforms to host our software, process electronic credit card payments, send SMS alerts, deliver media, and manage automated email invoices. These providers are contractually obligated to protect your data.

  • For Legal Protection: We will disclose information if required by Texas or federal law, or if we believe disclosure is necessary to protect our legal rights, property safety, or to enforce our financial collections process.

6. Data Deletion Rights & Requests

PICZELL respects your right to control your personal data. If you are a past client, property owner, or broker and wish to remove your files and data from our systems, you may submit a formal request:

  • How to Request Deletion: You must submit a formal Data Deletion Request via email directly to our support team at [Insert Support/Billing Email Address]. The email must come from the registered email address associated with your PICZELL account to verify your identity.

  • What Will Be Deleted: Upon verification, PICZELL will permanently remove your contact profile, text/SMS enrollment logs, property addresses, lockbox records, and historical communication data from our active databases.

  • Legal Exceptions: PICZELL cannot delete information that we are legally required to retain under Texas state law for financial accounting, corporate auditing, tax compliance, or active legal collection disputes. Itemized electronic invoices showing collected sales tax must be preserved for tax recording purposes.

  • Account Security: You are entirely responsible for maintaining the confidentiality of your login credentials for our secure media delivery portals.

  • Media Hosting Boundaries: While we store delivered media on our servers for a maximum of ninety (90) days per our Terms of Use, your account history and core contact profile remain secure until a formal Data Deletion Request is executed.
